# Panama Real Estate Scams: Rental & Purchase Checklist

By Legal Solutions • 2 minute read

![How to Avoid Real Estate Scams in Panama](https://legalsolutionspanama.com/hubfs/How%20to%20Avoid%20Real%20Estate%20Scams%20in%20Panama.jpg)

Before paying for a property in Panama, verify who owns it, whether the person signing can act for the owner, what rights the transaction transfers and where your money will go. A convincing listing, video tour or professional-looking contract does not replace those checks.

An owner can advertise directly without an agent; that alone is not evidence of fraud. Focus on documents, independent verification and payment controls rather than treating a particular listing channel as a guarantee of safety.

## Warning signs that justify pausing the transaction

Pause if someone pressures you to pay before verification, refuses to identify the owner or property, blocks independent access, or changes payment instructions unexpectedly. A low price can have a legitimate explanation, but it deserves investigation when combined with missing documents or urgency.

If you cannot visit, arrange an independent local inspection and a live walkthrough. Confirm the exact unit and address; pictures from a genuine property can still be used in a false listing. Do not send a deposit simply to keep a remote seller talking.

## Verify the owner, representative and agent

Ask for the property’s registry identification, commonly called the finca number, and have an independent lawyer check the [Public Registry information](https://registro-publico.gob.pa/images/PDF/Manual-de-Calificacin-del-Registro-Pblico-de-Panam.pdf). Match the registered owner with the person or company entering the contract. If someone signs under a power of attorney or for a company, verify their authority and any relevant limits.

If the person presents themselves as a licensed real estate broker, use [MICI’s licensed-broker information](https://mici.gob.pa/jtbr-corredores-de-bienes-raices-idoneos/) to check that claim. A licence is useful verification, but it does not guarantee the property’s title, condition or investment suitability.

## Rental and purchase checks are different

| Check | When renting | When buying |
| --- | --- | --- |
| **Ownership and authority** | Confirm the landlord can lawfully lease the unit | Verify the seller and authority to transfer the property |
| **Legal rights and restrictions** | Review lease terms and building rules | Review title, registered charges, access and restrictions |
| **Condition and ongoing costs** | Record inventory, damage, utilities and deposit terms | Inspect condition; check taxes, condominium costs and relevant approvals |
| **Payment** | Confirm payee, receipt and deposit-return conditions | Confirm closing safeguards, release conditions and registration steps |

## Before paying a rental deposit

Obtain a written lease identifying the property, parties, term, rent, deposit and payment destination. Specify what is furnished, who pays utilities and maintenance, the notice requirements and the conditions for returning the deposit. Ask your lawyer which rental registration and deposit procedures apply to the agreement.

Inspect the property and record its condition, inventory, meter readings and existing damage with dated photographs. Confirm the person leasing it has authority to do so, including permission to sublet if applicable. Check building rules for pets, parking, occupants and the intended rental duration.

Request a receipt for each payment and keep signed copies. If the agreement includes an English translation, make sure you understand any differences and which version governs.

## Before signing a purchase agreement

Have a lawyer independent of the seller review the title, registered charges and restrictions, seller’s authority, contract conditions and closing mechanism. Confirm the land or unit matches the documents. A registry review does not replace a survey, technical inspection or assessment of permits and access.

Ask for evidence concerning applicable taxes, condominium balances and relevant building or occupancy approvals. Agree who will resolve outstanding issues and what happens to your deposit if an essential condition is not met. For a condominium, review fees, shared facilities, rules and any known major works.

### Distinguish registered title from rights of possession

A property offered with rights of possession is not the same as a registered titled property. [ANATI’s procedures](https://www.anati.gob.pa/antecedentes/) distinguish possession-related recognition and titling processes. Such an offer is not automatically fraudulent, but the legal rights, transferability and possibility of obtaining title need specific examination. Do not pay a titled-property price on the assumption that title will follow automatically.

## Control the payment and closing process

Verify the payee and account details through an independently confirmed contact channel. If instructions change, call a known number rather than one supplied in the new message. Document why any payment goes to a representative or third party instead of the contracting owner.

For escrow, trust or other payment arrangements, obtain written terms stating who holds the money, when it is released, who authorizes release and when it is refundable. A label such as “escrow” is not proof that the arrangement protects you.

If you suspect a fraudulent payment, contact your bank promptly, preserve messages, contracts and receipts, and seek advice on reporting and recovery options. Do not make another transfer based on a promise that it will unlock a refund.

## Preguntas Frecuentes

#### Can foreigners buy property in Panama?

Generally, foreigners can acquire property, subject to restrictions. [Article 291 of the Constitution](https://www.gacetaoficial.gob.pa/gacetas/25176_2004.pdf) prohibits foreign individuals and certain companies with foreign capital from owning land within 10 kilometres of international borders. Island property also has specific conditions. Check the location and legal status of the property before buying.

#### Is it safe to rent directly from an owner?

It can be, provided you verify ownership or rental authority, inspect the property, agree clear written terms and document payments. Using an agent does not remove the need for those checks.

#### Does a lawyer guarantee that I cannot be scammed?

No. Independent legal due diligence can identify ownership, authority and contract risks, but no professional can guarantee every transaction is free of fraud. Combine legal review with inspections and payment verification.

#### Will buying a property automatically give me residency?

No. A [property-based residence application](https://legalsolutionspanama.com/en/residence-permits-panama/residence-permit-investor-panama/) must satisfy the specific category’s investment, documentation and approval requirements. Property ownership and immigration eligibility are separate.
