PERSONAL DATA PROTECTION AND TREATMENT POLICIES OF THE WEBSITE www.legalsolutionspanama.com, UNDER THE OWNERSHIP OF LEGAL SOLUTIONS LATAM S.A.

These Policies on the Treatment and Protection of Personal Data (hereinafter, the “Policies”) have been prepared in accordance with the provisions contained in Articles 42 of the Political Constitution of the Republic of Panama.

  1. Responsible for the Processing of Personal Data

  2. Object and Purpose of the Processing of Personal Data
    Legal Solutions Latam S.A. collects, stores and uses personal data of its customers for the purpose of conforming its customer database with the following purposes: commercial, promotion and marketing of its products and services in development of its social object.
  3. Previous Authorization of the clients of Legal Solutions Latam S.A for the Treatment of Personal Data
    The processing of personal data by Legal Solutions Latam S.A. requires the prior authorization of the holders of such personal data (users of Legal Solutions Panama), which must be requested, at the latest, at the time of collecting the personal data.
  4. Personal Data Protection Officer
    The area responsible for the protection of personal data of Legal Solutions Latam S.A., corresponds to the Marketing Area of Legal Solutions Latam S.A. (hereinafter, the “Personal Data Protection Officer”) who will process the requests, queries and complaints from the holders in the exercise of their right to know, update, rectify and delete their personal data, as well as revoke their authorization for the processing of them. The holders may request at any time to the Personal Data Protection Officer to inform him/her about the Policies, and about any change or modification to them.
  5. Rights of the holders

    The holders of the personal information will have the following rights: a) To know, to update and to rectify their personal information opposite to Legal Solutions Latam S.A. This right will be able to exercise, between others opposite to partial, inaccurate, incomplete, fractional information, which induce to mistake, or those which treatment is expressly prohibited or has not been authorized. b) To request proof of the authorization granted to Legal Solutions Latam S.A, in its condition of data controller. c) To be informed by Legal Solutions Latam S.A., previous request, about the use given to their personal data. d) To revoke the authorization and/or to request the suppression of their personal data when the treatment does not respect the principles, rights and constitutional and legal guarantees. e) To access free of charge to their personal data that have been object of treatment.

  6. Procedure for the exercise of rights
    6.1. Right of Access to Personal Data
    The holders will have the right to know if their personal data are being processed, as well as the scope, conditions and generalities of such processing. To this end, the holders will have the right to request the supply of their personal data to the Personal Data Protection Officer described in point 4 of this document, attaching a copy of their identity document to the request. 6.2. Right to consult personal data
    The holders or their successors may consult the personal data of the holders that rest in the database of Legal Solutions Latam S.A. For such effects, they will have to direct their consultations to the Personnal Data Protection Officer described in point 4 of this document, attaching a copy of their identity document to the request. The Personal Data Protection Officer will attend the consultations in a maximum term of ten (10) working days from the date of receipt of the same ones. When it is not possible to attend to a certain consultation within said term, the Personal Data Protection Officer shall inform the interested party in writing, expressing the reasons for the delay and indicating the date on which the consultation will be attended to, which in no case may exceed five (5) working days following the expiration of the first term.
    6.3. Claims
    The owners or their assignees who consider that the information contained in the Legal Solutions Latam S.A. database should be corrected, updated or deleted, or when they notice the alleged breach of any of the duties contained in Articles 42 of the Political Constitution of the Republic of Panama, may file a claim with the Personal Data Protection Officer described in point 4 of this document, which will be processed under the following rules:
    a) The claim will be formulated by means of a request addressed to the Responsible for the Protection of Personal Data, with the identification of the holder, a copy of his/her identity document, the description of the facts that give rise to the claim, the address, and accompanying the documents that you wish to assert. If the claim is incomplete, the Personal Data Protection Officer shall require the interested party within five (5) calendar days following receipt of the claim to correct the faults. After two (2) months from the date of the request, without the applicant submitting the required information, it will be understood that the applicant has withdrawn the claim.
    b) Once the complete claim is received, a legend will be included in the corresponding Legal Solutions Latam S.A. Database, stating “claim in process” and the reason for it, in a term not exceeding two (2) business days. Said legend shall be maintained until the claim is decided.
    c) The maximum term to attend the claim will be of fifteen (15) working days counted from the day following the date of its receipt. When it is not possible to attend to the claim within said term, the Personal Data Protection Officer shall inform the interested party of the reasons for the delay and the date on which the claim will be attended to, which in no case may exceed eight (8) working days following the expiry of the first term.
    6.4. Request for Revocation of Authorization and/or Deletion of Personal Data
    The holders may at any time request the Personal Data Protection Officer described in point 4 of this document to delete their personal data and/or revoke the authorization granted for the processing of such data, by submitting a complaint.
  7. Information Security
    Legal Solutions Latam S.A., is committed to the correct treatment of the personal data of the holders, avoiding the non authorized access of third parties that allows to know or to violate, to modify, to disclose or to destroy the information that rests in its data bases. For this reason, Legal Solutions Latam S.A., has security protocols and access to their information systems, storage and processing, including physical security measures for this purpose.
  8. Policy Validity
    These Policies will be in force from the first day (1) of April 2019, and will be in force during the existence of Legal Solutions Latam S.A.. Legal Solutions Latam S.A.’s client database will remain in force during the time that is reasonable and necessary, according to the purposes that justified the treatment, taking into account the provisions applicable to the matter in question and the administrative, accounting, tax, legal and historical aspects of the information.

    LEGAL SOLUTIONS LATAM S.A, in compliance with the provisions of the Political Constitution of the Republic of Panama, in its article 42, informs you that it has in its database information previously provided by you, which has been collected for commercial and marketing purposes carried out in the development of our corporate purpose.

    In accordance with our Policies on the Treatment and Protection of Personal Data, we inform you that your personal data are treated confidentially and the Company guarantees the security, reserve and confidentiality of the same.

    The Company requires your authorization to continue processing your personal data to fulfill the purposes described above.

    If you wish your personal data to be excluded from the Company’s database, we request that you inform us by writing to Ave. Samuel Lewis and Calle 34E, Obarrio. Torre Generalli, 20th Floor, Panama City, Telephone: +50766773425, email info@legalsolutionspanama.com , within a period of thirty (30) working days from the date of receipt of this communication, if after the above period we do not receive a communication from you in the terms described above, the Company will be authorized by you to continue using your personal data to fulfill the same purposes.

    The foregoing is without prejudice to your right to know, update, rectify and delete your personal data at any time in the terms set forth in Article 42 of the Political Constitution of the Republic of Panama.
